En la última década, la economía de plataforma se ha expandido en España, Portugal, Rumanía y Alemania. Sin embargo, solo en España y Portugal los Gobiernos nacionales han adoptado nuevas legislaciones. En España, la “Ley Rider” de 2021 estipula que los repartidores deben ser considerados como empleados y, por tanto, tienen derechos básicos. En Portugal, la llamada “Ley Uber” introduce una presunción de empleo al definir una plataforma electrónica y regular el estatus laboral de los trabajadores individuales de la plataforma. Además, las plataformas en línea y los trabajadores de plataformas están obligados a inscribirse en un registro central para poder prestar sus servicios.
A diferencia de España y Portugal, las plataformas online no se enfrentan a una normativa tan específica en Alemania y Rumanía. En la esfera pública rumana, la economía de plataforma se ha discutido como un fenómeno nuevo y positivo que fomenta la flexibilidad y la autonomía en comparación con el empleo estándar. En consecuencia, la importancia de la protección social, la negociación colectiva o las condiciones de trabajo de los trabajadores de las plataformas se han descuidado en gran medida.
En Alemania, a pesar de las múltiples iniciativas de base que abordan los derechos de los trabajadores de plataformas, los debates públicos se han centrado más en la protección de datos en el lugar de trabajo. Varios partidos y sindicatos han pedido una ley de protección de datos de los empleados, además de los requisitos establecidos en el RGPD.
Este evento de FES Futuro del Trabajo, FES España & Portugal y FES Rumanía intenta abordar la cuestión del trabajo en plataformas, las plataformas online y los trabajadores de plataformas en España, Portugal, Rumanía y Alemania.
